Data protection

Fundamental Principle

Nowadays, a lot of data of all kinds are collected and processed – especially by electronical means. New European regulations regarding data protection will come into force on 25 May 2018 (EU General Data Protection Regulation / GDPR). The GDPR protects and empowers all EU citizens data privacy, and creates a transparency of data processing in reference to personal data of a natural person. ND PressTec GmbH will adopt and comply with the new regulation.

Data Processing

ND PressTec GmbH collects and processes data, resp. personal data, of potential buyers, customers and suppliers in accordance with legal norms concerning the protection of personal, information and data security. It does this in compliance with purpose limitation solely for drawing up contract agreements between ND PressTec GmbH and business partners and for the performance of contracts. In this context it must be stressed that we follow the principle of data minimization [article 5, subsection 1 c) GDPR] by only processing data, which is adequate, relevant and limited to what is necessary in relation to the purposes, for which they are processed.

Customer data: Processing of collected data and, respectively, personal data of our customers serve the purpose of performing a contract [article 6, subsection 1, sentence 1 b) GDPR]. Any recorded or stored contact data is solely used by our sales department or accounts receivable in the sense of business for example generating offers, bills of delivery and invoices, or recording incoming payments. Customer data is neither sold to third parties nor used for any other purposes.

Supplier data: As mentioned above, data, respectively personal data, concerning our suppliers is used for business purposes only [article 6, subsection 1, sentence 1 b) GDPR]. To secure the purchase of raw materials, utilities, supplies and services we process addresses, contact data and bank account data of our suppliers in our purchasing department and accounts payable department to carry out orders and payments. As with our customer data, supplier data is neither sold to third parties nor used for any other purposes.

Transmission to third party: In principle, personal data is only transmitted or otherwise forwarded to third parties if this is necessary for the purpose of contract performance or accounting or the data subject has given his or her consent beforehand. In the context of contract performance, we transmit data necessary for the transaction of orders to third party service providers (carriers, logisticians, banks). Such data shall be used by our service providers only to accomplish their task. Ulterior use of information, data or personal data is not permitted, and does not occur at our assigned service providers [article 6, subsection 1, sentence 1 b) GDPR].
Furthermore, personal data is transmitted in individual cases, if it is necessary for the purpose of establishing, exercising or defending legal claims and if there are no grounds to believe that the data subject has an overriding legitimate interest in the data not being transmitted or if the transmission is necessary for compliance with a legal obligation according to article 6, subsection 1 sentence 1 c) GDPR.

Application Data

During an application process, we collect and store data and personal data of applicants in a data base. After finalizing a respective application process, we erase all data and personal data immediately without being requested to do so.
If our Human Resources department sees an applicant in another optional, alternative position s/he will be contacted in a separate e-mail or message to receive their consent that their personal data may be transferred to the other application process and processed for this purpose.

Transparency of Data Processing

Data subjects have the right of access [article 15 GDPR] and the right to rectification [article 16 GDPR], which means that they may at any time obtain information about the extent and the nature of their processed data and to obtain rectification of their data.

Furthermore, data subjects have the right to erasure [article 17 GDPR] and the right to restriction of processing locked [article 18 GDPR] if the processing is unlawful.
According to article 20 GDPE, data subjects have the right to receive the personal data concerning him or her, which he or she has provided, in a structured, commonly used and machine-readable format and to transmit those data to another controller.
According to article 77 GDPR, data subjects have the right to lodge a complaint with a supervisory authority. Generally, for this purpose, they can contact the supervisory authority of their habitual residence, place of work or of our place of business.

According to article 21 GDPR, data subjects also have the right to object, on grounds relating to his or her particular situation, to the processing of their personal data.
In this regard we want to point out the legitimate retention periods which are relevant for certain data and documents which are required by certain laws.

Contact Mail Address and form

The mail address and contact form on our website is seen as initial contacting in terms of inquiries of potential buyers or applicants by which their data and their requests are forwarded to the appropriate department. In this connection, name, company name, address and e-mail address as well as the request itself are processed. Before sending an answer, we use the so-called double-opt-in method, which means that we will only send a reply via e-mail after the contacting person has explicitly agreed that s/he contacted us. We will then send a confirmation e-mail to the contacting person asking this person to confirm that s/he has contacted us. In doing so, we will also name the purpose of contact (e.g. inquiries of potential buyers or applications).

If a request is completed, all collected data and personal data will be erased immediately.
